Business Type

Choose the industry best describes your business?

Industry

Based on industry, South Carolina businesses are responsible for a variety of regulations, licenses, permits, and registrations. It is important to identify which of these responsibilities apply to your business.

Regulations

Business regulations safeguard your business, customers, employees, and industry. These regulations also make sure that the products, services, and practices of business benefit the public.

Business Structure

What is your business structure?

Business Structure Types

Choosing the right business structure impacts your tax responsibilities, funding options, registration requirements, and personal liability.

Learn more about choosing the right business structure at the U.S. Small Business Administration (SBA) website.

Business Location

In what county and city are you doing or planning to do business?

Find Your County and City

Locate your county and city using our interactive map.

The location of your business determines the business license you will need. To determine what local business license(s) you may need, contact the county and city where your business is operating.

NOTE: South Carolina does not offer a statewide business license.

Tip: Online businesses use your home address (If operating out of your home)

Employees

Do you have or plan to hire employees?

Employees

There are many employer requirements and responsibilities, which include:

  • Necessary Employer Actions
  • Withholding Tax
  • Unemployment Tax
  • Work Opportunity Tax Credit
  • Workplace Posters
  • Employer Resources

Second job, independent contracting, or gig work

The South Carolina Department of Revenue (SCDOR) reminds gig and independent workers that you still must report your income on an Individual Income Tax return, even if you are paid in cash or goods and may not receive a W-2 or 1099.

According to the IRS, gig workers and independent contractors are generally required to pay:

  • Income Taxes
  • Federal Insurance Contribution Act or Self-employment Contribution Act Tax
  • Additional Medicare taxes

Additional Tips:

  • Keep good records of business expenses and income. Deductions can lower your tax bill, but they must be supported by records. Double check the rules for deducting expenses related to use of things like your car or house.
  • Gig economy workers who have another job where their employer withholds taxes from their paycheck can fill out and submit a new Form W-4. Do this to request withholding additional taxes from your paycheck to help cover your gig work.

Self-Employed

According to the IRS, Self-Employed individuals are generally required to pay:

  • Income Taxes
  • Federal Insurance Contribution Act or Self-employment Contribution Act Tax
  • Additional Medicare taxes

If your business is your primary income, you should make quarterly estimated tax payments:

  • By making quarterly estimated tax payments, you can pay your Income Taxes and any self-employment taxes owed throughout the year.
  • Failing to make quarterly payments can mean a big bill at the end of the year that you cannot afford and could generate penalties and interest.
  • The easiest way to make quarterly estimated payments is by using MyDORWAY, the SCDOR's free online tax portal.
    • You can make a quarterly estimated tax payment without creating an account by clicking Make a Payment on the MyDORWAY homepage, then choosing Individual Income Tax Payment. After entering your name and SSN, choose Estimated Payment on the next screen.

Taxpayers who make quarterly estimated payments are encouraged to sign up for a MyDORWAY account and log in before making their payments. Get started by visiting dor.sc.gov/mydorway-signup.
